Terms of Use

1. About the Service

Multiconex is a software-as-a-service (SaaS) multi-agent customer service platform for WhatsApp Business, developed and operated by Juan Pablo Cordeiro Baraúna, CNPJ 32.289.461/0001-12, with registered office at Rua Coronel Antônio Pessoa, 48-A, Loja 01, Centro, Campina Grande/PB, CEP 58400-262.

The platform enables companies to manage multiple agents and conversations via the WhatsApp Business Cloud API — Meta Platforms' official API — in a centralized dashboard.

2. Acceptance of Terms

By creating an account and using Multiconex, the user and the company they represent declare that they have read, understood, and fully agreed to these Terms of Use. If you do not agree with any provision, use of the platform is not permitted.

3. Account Usage Conditions

To use Multiconex, the user must:

• Be at least 18 years old or a legal representative of a legal entity;
• Provide accurate information during registration;
• Keep access credentials confidential and not share them with third parties;
• Notify Multiconex immediately in case of unauthorized account use.

4. Permitted and Prohibited Use

The user agrees to use the platform exclusively for legitimate customer service, support, sales, and business communication via WhatsApp Business.

The following is expressly prohibited:

• Sending unsolicited messages (spam) or bulk messages without proper recipient consent;
• Initiating conversations with recipients who have not provided opt-in (explicit consent to receive communications via WhatsApp) — the client is solely responsible for collecting and recording such consent before using the platform to contact end users;
• Using the platform for illegal, fraudulent activities or activities that violate third-party rights;
• Sending content that violates WhatsApp Business Acceptable Use Policies or Meta Platforms policies;
• Attempting to access other clients' data on the platform;
• Reverse engineering, copying, or redistributing the software.

5. WhatsApp Business Cloud API Integration

Multiconex uses the WhatsApp Business Cloud API, Meta Platforms' official platform, to send and receive messages. Use of this integration is subject to the WhatsApp Business Policies and the Meta Platform Terms.

The client is solely responsible for ensuring that sent messages comply with Meta policies, including respect for conversation windows, approved templates, and end-user opt-in.

6. Intellectual Property

All platform content — including source code, design, logos, and text — is the exclusive property of Multiconex and is protected by intellectual property law. The user does not acquire any rights to these elements through use of the platform.

Messages and conversation data managed by the client belong to the client. Multiconex does not claim any rights over the content transmitted.

7. Limitation of Liability

Multiconex is provided "as is", without guarantees of uninterrupted availability. We are not liable for:

Our total liability, under any circumstance, shall not exceed the amount paid by the client in the last 3 (three) months of service.

• WhatsApp Business API or Meta service unavailability;
• Data loss caused by third-party failures;
• Indirect damages, lost profits, or consequential losses arising from use of the platform.

8. Term and Termination

These terms remain in effect while the client maintains an active account on Multiconex. The client may close their account at any time. Multiconex may suspend or terminate accounts that violate these terms, without prior notice in serious cases.

9. Changes to Terms

Multiconex may update these Terms of Use at any time. Significant changes will be communicated by email or platform notification. Continued use after notification implies acceptance of the new terms.

10. Governing Law and Jurisdiction

These Terms are governed by Brazilian law. The courts of Campina Grande, Paraíba, Brazil (Campina Grande/PB) are elected as the exclusive jurisdiction to resolve any disputes arising from this agreement.
